All I have to say is dear God I need a vacation! Ok So I get a call from our negotiator yesterday which turned in to a massive nightmare that I may NEVER live down! Ok Well here goes nothing and I hope and pray that you can follow........
Mr.Nicholas calls my phone around 2 yesterday afternoon and tells me that he has the terms of our new mod and they are as follows 5.875% interest rate (what it has been since we modded the loan in 2008), extended the term of the loan to 40 years (great I will be 70 when it gets paid off), HERE is the KICKER from HELL Payment amount is $841.75 (THAT IS NOT LOWER THAN WHAT OUR PAYMENT IS NOW!) Our payment BEFORE the mod is $768.19......................that being said how in Gods name is that significantly lower payment as he stated in the phone call on I think it was Monday? It isn't even close!!!! On top of that he tells me thats a great chance since our loan was due to to adjust its rate terms in 2012 and I about had a coronary our loan ha NEVER been an adjustable rate loan. I do NOT know where this came from and asked him to find the documents stating that and send me a copy of them and low and behold he cannot find a copy of our documents that we signed. He said Oh i can see the change of deed of trust but cannot find anything stating that fixed rate and cant find anything supporting the adjustable rate mortgage either. So what does Mr.Nicholas tell me, Oh don't worry about it now you have a modification on the loan so there's nothing to worry about it wont ever adjust. I FLIP on him telling him he has really lost it and needs to find supporting documents stating this. On top of the adjustable rate mess GUESS WHAT ELSE IS REALLY PISSING ME OFF.................He stated that the modification that we were denied for in 2010, the one for the incorrect notary seal was approve and retroactively implemented in December 2010. I said DO WHAT???? Then he tried to tell me "Yes, ma'am closing took till Dec 2010 to implement the modification that you signed in Dec 2009!" Then he tells me that we have not made a payment since November 2009 I Flipped again! Because I have supporting documents stating otherwise and he has no clue who he just upset. I need advice I need help I dont know what I need at this point but you had best believe that I contacted the senators office with this new information. On top of that he gave me a different set of dates that the CEO and Presidents office didnt give me. How many sets of books does this company have and how many do not co-inside with each other? My Lord someone give me a break!

Got a call from the Negotiator today
Apparently I needed to contact the office of Senator Burr long before now! Reason being is that it really has moved in the past month. What I have found out today is that they have a final approval and paperwork is in the making. Of course he could not find the specifics on the account but that there is a significant payment reduction and interest rate reduction THANK GOD that's what I have to say! There was a date error on the paperwork or he would have had that info at his finger tips. So by the end of this week we will be looking for that lovely package from UPS and I am MORE than willing to get that crap done. They are talking about $275 reduction in payments that alone will make our lives much easier. They will drop all late fees and fix our credit reports! So this isnt over yet! The fat lady has yet to burst out into song!

If BOA could crap on any one they certainly have done so!
Ok so BOA was given until 7-15-2011 to respond to Senator Burrs office and boy did they ever respond. Not only did they respond but they ripped us a new one!
The letter they sent to Senator Burrs office reads:

2-A payment in the amount of $853.18 was required along with your signed and notarized modification package to facilitate approval. That did not occur. We had discussed with the representative that since there was over $900 in the holding pot that we did not have to make that initial payment and that was told that it was OK for us to use those funds for the first payment.
3-On December 12, 2009, your modification was decined. This is new news to me because the paper work was not due back until December 17,2009! The actual decline was March 17,2010.
4-Another modification review began on March 26,2010, in with a request for financial documentation was made and required to be returned by April 17, 2010, we did not receive the requested documents by this required due date. Let me just call BS right now because I had faxed AND Fed-Ex'd the paperwork requested to them NUMEROUS times!

He brings home $590 a week after taxes before taxes its $845 per week and they calculate it at 4.3 weeks so that's $3633.50 per month before taxes and health insurance. Not only that they were using MY income and I am not even on the loan!

Ok there may be some vindication here but....New update
Ok after dealing with many many many many incompetent people at BOA Home loans or what ever they are called now I ACTUALLY got to speak to my negotiator.......well new negotiator. Mr.Nicholas Nissen at 877-430-1431 ext 204319 he is in the office from 12-9 est so thats helpful information. THEN he looks through the account as I am speaking with him on the phone and says that we have been through a HUGE ordeal........well DUH! What makes you think that? Anyway, he states that we now have approval from the investor that it has to go through somewhat of a process still to get everything completed. BUT.......I do not have the terms yet as they only sent the approval over from the investor but not the terms (weird but Ill take what I can get). We have to go through the whole QA process but we may be over and done with within a week...Crossing my fingers as this would be an answer to my prayers. Now if only I could sleep! I will update as soon as I hear from him regarding the terms of the modification.

Here's one for the books.............
This morning I received a call from BOA Home loans office of the CEO and president by an unnamed caller because he declined to ID himself. and after he so nicely asked to speak to Jeffrey (My husband) I informed him that he was not available to speak right now as he is at work. So then he states that he will call back at a later time. I inform this unknown caller that I am able to speak on behalf of the loan and he states that the authorization that he has in front of him is for Countrywide. Good lord I have spoken with that office before and now he has me blacklisted from the office of the ceo and president as not able to be given anything but basic info no details of what is going on. I have never been so furious in my life. So I went totally unorthodox today and went on Facebook and Messaged both Amy and Ms. Amadasu to find out what in the world is going on with the loan mod as theres apparently something up but no one wants to tell me what is going on with my home. How stupid is this mess! One department sees that I am able to speak on behalf of the loan but the other screams sorry it was only for countrywide..............BOA bought ALL countrywide loans its the same loan number for gods sake AND i gave him any and all info that he wanted on the account and told him things that he didnt know. but to no avail I got nothing..............BUT Today is the last day BOA had to respond to the Office of the Commissioner of Banks for NC so lets see how that turned out!

New month same mess
I call into BOA on Friday 7/1/2011 and speak to Amy's Supervisor David and he tells me that nothing has happened on the loan and that it was still waiting on the Investor approval that was sent of on June 10th.........HOW MANY MORE TIMES WILL THIS DATE CHANGE.........what date did they send it to the Investor? This is Crap in the worst of ways. I attempt to get information and hear that word "REVIEW" it makes me want to PUKE! On another note there is yet another class action suit against BOA or BAC home loans whatever name you want to use for the same crap we are going through.
