nothing has changed with this major corporation! They do not care about the average person they just group us all together and sell it off. Here's what has been going on thus far......
June 6th 2012 BOA sent us to the foreclosure department.......
July 12th 2012 BOA "supposedly" sent us trial modification papers via Fed Ex. Nothing received in an overnight package as they usually send.
July 19th 2012 got a call from BOA asking if we were going to accept the new trial mod they sent us a week prior. We knew nothing about it and neither did our "attorney".
July 22nd 2012 FINALLY received trial payment documents along with the terms of the proposed modification. We instinctively were hesitant and wanted a few answers but our "attorney" refused to give them stating that he was not a financial auditor and he would charge an hourly fee if it were to come to that. When truly I was just asking for him to contact BOA to get that information not his office do that. It isn't hard to make a flippin' phone call and since we were not allowed to make that phone call we couldn't find out on our own. The terms of this lovely piece of work was to extend our loan to 40 years, raise our payments by over $100 a month, and reduce our interest rate to 4.875% for the life of the loan. However, the problem is they are going to get the same amount as if they hadn't reduced the interest rate by extending the loan out to 40 years! They also would be getting double interest on the past due balance because it essentially would be charged twice! I am no dummy but geeze what a way to do business.
August 3, 2012 we fire our lovely "attorney" for his lack of compassion, willingness to work, and got a response that beats them all, he stated that "he already considered our relationship terminated" WHAT?! You stated you would be with us until it was made permanent but you figured that since you think you got us this modification that you had done your job. *itch please! You satiated the issue we could have done this on our own, you did nothing that we didn't already do you just undid what we had done and threw it to the wind. The ONLY reason this attorney was in the office of the CEO and President was because of ME! He had NO clue how he got there! His other statement to us was that "the home is ours, for now, to do what we wish with" WTF is this all about? We informed him we were going to file chapter 13 bankruptcy instead of extending our loan out another 10 years and giving BOA MORE money that they do not need. Someone doesnt understand bankruptcy (hes got a bankruptcy atty in his office he should get schooled)
August 22,2012 we decided that we were going to file chapter 13 bankruptcy in order to keep our home. What other way were we going to do it as no one could tell us exactly when the new trial payment was due. paper said one thing attorney said one thing and BOA rep said another. I dont believe any of them! We didnt get the standard 30 days from when we got the paperwork we were expected to do it in less than 2 weeks. That wasnt fair to us we cannot help BOA didnt get the paperwork to anyone in time.
With that it is now September 13, BOA called yesterday asking how the trial mod was going. Ummmmmm.....its NOT! We filed chapter 13 bankruptcy in August. They were so very confused. The guy that called stated that he spoke with Julio (yet again theres that name that no one knows who he is) and that everything was going well, they had received the first two modification payments and were excited that we got this far. Yet again ummmmm.....we havent sent in a payment since November 2009! They have been playing with our money that we had paid into the account for previous trial mods and somehow paid our payment for us LOL So stupid. The guy on the phone was so caught off guard it wasnt funny. Apparently as well we have a new interest rate of 6.875% and its a conventional fixed. What is this conventional crap?
When I asked him when this happened he stammered just a bit more and told me he would have to get back to me on that because he did not know. Now to the meat and potatoes of it all. BOA called to collect a debt! They VIOLATED bankruptcy code because they had been notified of the bankruptcy on the 23rd of August on TOP of filing bankruptcy paperwork on the 27th of august with the county court. What will they do next?
The reason I put "attorney" in quotes is that we fired him after his snarky attitude to us telling us we should just be grateful that we got anything at all that he has never had a client that was always looking in the past and wasnt relieved to get a modification after so long. But given the mess that we have been through I think we have the right to be hesitant until it is set in stone. Of course the mod was given after I contacted the consumer financial protection bureau.

Well the poop hit the fan as BOA has sent us the beginning of foreclosure paperwork. Our attorney doesn't seem phased about this at all and just said oh well we will see what we can do. This is super frustrating and now I am looking at filing chapter 13 bankruptcy to get things straightened out. I am super frustrated and upset at this whole ordeal. HELP!!!!!!!!!!!

Well Nothing new BUT............
After my last post I guess I should post a reply back on that. I now understand why our attorney is not getting a call back. Our negotiator is still the same slacker that we had before when I was working with it. The way that the attorney worded it is that we had a new negotiator SO that being said I am not at all concerned because this is the same nit wit that told me we "signed" papers but could never produce a copy of them and that we were denied over a Dodd Frank Certification Letter or that we didnt make our payments which I have proof of so yeah this crazy woman Valerie Williams is in no hurry to get things on the move. This is the SAME woman who told me 3 or 4 weeks ago that she would call me back............she called alright, called and hung up! Grrrr LOL Oh well BOA play your games I am sitting back watching and laughing because if this ever makes it to court I feel sorry for you!

Yes it has been a while
I know it has been a while since I have posted on this blog about what is going on with Bank of America home loans. Well lets just say no one really knows what is going on with it. We had our trial payments paid for three months and did as we were supposed to (the amount was different than what was on the paperwork as we were told via the negotiator Pamela Mitchell that we were to pay $650.43 instead of the $847.28 So we paid diligently every month only to find out she never approved that with anyone just gave me some lame excuse was transferred over to ANOTHER negotiator by the name of Valerie Williams who keeps trying to tell me we cannot afford our home loan (we can afford the payments we are at now just not to pay the arrears) Well she said now that it was denied over not having a dodd frank letter or frank dodd letter whatever you want to call the stupid sheet of paper that BOA cannot find when they sent that out to us. Well December 28th we hired an attorney to help out with the ordeal and well needless to say BOA is giving him the same crapola they have given us and on top of that I am getting a gut feeling that I do not like at all that the attorney is a scam artist. Reason being is that in the paperwork that I re-read, he states not to contact our lender. UMMMM............but no reason as to why. I need to know what is going on and he cannot tell me if we have even been reassigned a new negotiator I just want to cry I do not know where to go what to do or where to even begin and deciphering this mess.

I state this information above because I have been informed now by two different agents that BOA cannot find our loan docs only the Deed of trust changing names from my Father In Law and my husband to Me and my husband. I personally am not on the loan but I have dealt with so much mess with this I feel like BOA should OWE ME!!
Well I got a letter in the Mail today from Senator Burrs office and it contained a novel from the OCC (Office of the Comptroller of Currency) Heres what it said (or lack there of:)

In response to my inquiry on your behalf, I have received the enclosed correspondence from BOA regarding your mortgage issues.
I truly regret that it is taking so long to resolve this matter. I realize that this must be very frustrating to you. However, it seems BOA has recently made two unsuccessful attempts to contact you.
Once you have contacted Mr. Nicholas Neisen at 877-430-1431 to discuss your options, please contact Susan Hatfield in my Winston-Salem office at 336-651-5125.
In the meantime, if you have any questions, or if I can be of further assistance please feel free to contact my office.

Follow that? LOL
NOW.............Here is the lovely letter from the OCC......
Dear Senator Burr,
The OCC is responding to your constituent's letter regarding the above referenced financial institution. The focus of the OCCs review of consumer complaints against national banks and federal savings associations (thrifts) is to determine whether the financial institutions' actions are consistent with banking statutes, regulations or any policies that are applicable to nationally chartered banks.
Mr. and Mrs. Sawyer requested mortgage loan modification assistance that would allow them to retain ownership of their home. they say despite providing all requested financial and repeated calls and contacts to the bank, no one could explain the continuing delays or clarify the status of their modification requests.
The OCC contacted the bank and as a result the bank responded to Mr and Mrs Sawyer and our office on July 15,2011. Another copy of that response is included in this letter for your records.Based on our assessment of the matter, our conclusion is the bank now provides additional relevant and salient information not included in the Sawyer's letter.
The bank clarifies that the Sawyer's began requesting mortgage modificaiton assistance in September 2008. Over the years, the bank and investor Fannie Mae repeatedly asked the Sawyer's for current, complete and comprehensive financials but the Sawyer's did not honor any of those requests.
Matters continued over the years and the bank and Fannie Mae continued accepting the Sawyer's requests. The Bank and fannie Mae still never received current or complete financials and thy remained unable to move the process forward. The bank and fannie mae will need the Sawyer's continuing cooperation, participation and co-active assistance throughout all phases of the mortgage modification process.
The OCC is an administrative agency and we have no authority to moderate, mediate, or arbitrate new mortgage contracts between private consumers and their bank. All these matters are negotiations and remain entirely private, proprietary, and confidential between borrowers, bank, and investors at all times.
The Sawyer's themselves will now have to strategize how best to pursue further modifications that might allow them to retain ownership of their home. The OCC cannot coerce, compel, or demand that the bank or investor Fannie Mae offer the Sawyer's a new mortgage contract that contain specific rates, terms or conditions.

Ok where to start with this letter......I have tried to contact the OCC for over a year now and have not gotten anywhere but if Senator Burr contacts them WHOO HOO lets jump on that! Right Hand....Meet Left Hand.....Now that you have met......
Lets get this crap together! For Gods sake or whomever you worship lets all get our cute little duckies in a row and quit letting the one run down the hallway screaming "AFLAC!" That being said BOA cannot get everything together in the least bit! I called in today to what was new and boy was that a life long mistake! Ok we have been assigned a "monitor" by the name of Pamela Mitchell phone number 8774031431 ext 276041 and she was assigned on the 28th of July.So This was told to me as she was my new negotiator and I flip on that poor CSR who is only reading her screen.So I call the number above and get her associate by the name of Dewayne Davis at ext 276013 (Hey wait wasn't that Amy's extension?, I will have to look that one up again in a few minutes!) Ok well come to find out Ms.Mitchell is just watching over the loan to make sure that we are dotting our I's and crossing our T's appropriately. Little do they know we have done that correctly all along it is BOA who is using the White-Out! So then I asked Mr.Davis about the paperwork, he puts me on hold only to come back on the phone and says "I cannot find an Air Bill for the documents" They have not made procurement yet and have not been drawn." The modification hasnt even closed yet, they have NO terms and are not sure where the ones Mr.Nissean has told me on Friday. So tomorrow I am going to look for an attorney because this is becoming quite the mess. Someone say a prayer, I am liable to choke someone this has been a nightmare that I was hoping was so close to being complete. Way to rip that rug out from under my feet BOA!
