I state this information above because I have been informed now by two different agents that BOA cannot find our loan docs only the Deed of trust changing names from my Father In Law and my husband to Me and my husband. I personally am not on the loan but I have dealt with so much mess with this I feel like BOA should OWE ME!!


Well I got a letter in the Mail today from Senator Burrs office and it contained a novel from the OCC (Office of the Comptroller of Currency) Heres what it said (or lack there of:)

Senator Burrs office states:
Dear Jeff and Christina,
In response to my inquiry on your behalf, I have received the enclosed correspondence from BOA regarding your mortgage issues.
I truly regret that it is taking so long to resolve this matter. I realize that this must be very frustrating to you. However, it seems BOA has recently made two unsuccessful attempts to contact you.
Once you have contacted Mr. Nicholas Neisen at 877-430-1431 to discuss your options, please contact Susan Hatfield in my Winston-Salem office at 336-651-5125.
In the meantime, if you have any questions, or if I can be of further assistance please feel free to contact my office.

Well thank you Senator Burr................BOA has not attempted to contact me I contacted THEM numerous times over the past few weeks and have gotten the run around and the most recent is that I cannot contact the regular number at 800-669-6607 because they have it blocked from the people that will actually tell us what is going on from telling us from what is going on on the mod! Follow that? LOL
NOW.............Here is the lovely letter from the OCC......
Dear Senator Burr,
The OCC is responding to your constituent's letter regarding the above referenced financial institution. The focus of the OCCs review of consumer complaints against national banks and federal savings associations (thrifts) is to determine whether the financial institutions' actions are consistent with banking statutes, regulations or any policies that are applicable to nationally chartered banks.
Mr. and Mrs. Sawyer requested mortgage loan modification assistance that would allow them to retain ownership of their home. they say despite providing all requested financial and repeated calls and contacts to the bank, no one could explain the continuing delays or clarify the status of their modification requests.
The OCC contacted the bank and as a result the bank responded to Mr and Mrs Sawyer and our office on July 15,2011. Another copy of that response is included in this letter for your records.Based on our assessment of the matter, our conclusion is the bank now provides additional relevant and salient information not included in the Sawyer's letter.
The bank clarifies that the Sawyer's began requesting mortgage modificaiton assistance in September 2008. Over the years, the bank and investor Fannie Mae repeatedly asked the Sawyer's for current, complete and comprehensive financials but the Sawyer's did not honor any of those requests.
Matters continued over the years and the bank and Fannie Mae continued accepting the Sawyer's requests. The Bank and fannie Mae still never received current or complete financials and thy remained unable to move the process forward. The bank and fannie mae will need the Sawyer's continuing cooperation, participation and co-active assistance throughout all phases of the mortgage modification process.
The OCC is an administrative agency and we have no authority to moderate, mediate, or arbitrate new mortgage contracts between private consumers and their bank. All these matters are negotiations and remain entirely private, proprietary, and confidential between borrowers, bank, and investors at all times.
The Sawyer's themselves will now have to strategize how best to pursue further modifications that might allow them to retain ownership of their home. The OCC cannot coerce, compel, or demand that the bank or investor Fannie Mae offer the Sawyer's a new mortgage contract that contain specific rates, terms or conditions.

All I have to say about this is OMG! Ok where to start with this letter......I have tried to contact the OCC for over a year now and have not gotten anywhere but if Senator Burr contacts them WHOO HOO lets jump on that! Heck with the consumer. NOW............We have NEVER NEVER NEVER EVER not sent the information that BOA or Fannie Mae has asked for. Sent MANY faxes to them numerous times, Emailed numerous times and Fed-ex'd many times all documentation needed or asked for. They dont always put it in the system in a timely manner but I certainly have complied. I also want to know where in the world did the Sept. 2008 date come from??? This mess didnt start till July 2009. This is another date to add to this mess. Oh what a nightmare! HELP!!! I am liable to go grey at 30!

Right Hand....Meet Left Hand.....Now that you have met......

Lets get this crap together! For Gods sake or whomever you worship lets all get our cute little duckies in a row and quit letting the one run down the hallway screaming "AFLAC!" That being said BOA cannot get everything together in the least bit! I called in today to what was new and boy was that a life long mistake! Ok we have been assigned a "monitor" by the name of Pamela Mitchell phone number 8774031431 ext 276041 and she was assigned on the 28th of July.So This was told to me as she was my new negotiator and I flip on that poor CSR who is only reading her screen.So I call the number above and get her associate by the name of Dewayne Davis at ext 276013 (Hey wait wasn't that Amy's extension?, I will have to look that one up again in a few minutes!) Ok well come to find out Ms.Mitchell is just watching over the loan to make sure that we are dotting our I's and crossing our T's appropriately. Little do they know we have done that correctly all along it is BOA who is using the White-Out! So then I asked Mr.Davis about the paperwork, he puts me on hold only to come back on the phone and says "I cannot find an Air Bill for the documents" They have not made procurement yet and have not been drawn." The modification hasnt even closed yet, they have NO terms and are not sure where the ones Mr.Nissean has told me on Friday. So tomorrow I am going to look for an attorney because this is becoming quite the mess. Someone say a prayer, I am liable to choke someone this has been a nightmare that I was hoping was so close to being complete. Way to rip that rug out from under my feet BOA!

Not sure where to begin (this is a bigger mess than I anticipated)

All I have to say is dear God I need a vacation! Ok So I get a call from our negotiator yesterday which turned in to a massive nightmare that I may NEVER live down! Ok Well here goes nothing and I hope and pray that you can follow........
Mr.Nicholas calls my phone around 2 yesterday afternoon and tells me that he has the terms of our new mod and they are as follows 5.875% interest rate (what it has been since we modded the loan in 2008), extended the term of the loan to 40 years (great I will be 70 when it gets paid off), HERE is the KICKER from HELL Payment amount is $841.75 (THAT IS NOT LOWER THAN WHAT OUR PAYMENT IS NOW!)  Our payment BEFORE the mod is $768.19......................that being said how in Gods name is that significantly lower payment as he stated in the phone call on I think it was Monday? It isn't even close!!!! On top of that he tells me thats a great chance since our loan was due to to adjust its rate terms in 2012 and I about had a coronary our loan ha NEVER been an adjustable rate loan. I do NOT know where this came from and asked him to find the documents stating that and send me a copy of them and low and behold he cannot find a copy of our documents that we signed. He said Oh i can see the change of deed of trust but cannot find anything stating that fixed rate and cant find anything supporting the adjustable rate mortgage either. So what does Mr.Nicholas tell me, Oh don't worry about it now you have a modification on the loan so there's nothing to worry about it wont ever adjust. I FLIP on him telling him he has really lost it and needs to find supporting documents stating this. On top of the adjustable rate mess GUESS WHAT ELSE IS REALLY PISSING ME OFF.................He stated that the modification that we were denied for in 2010, the one for the incorrect notary seal was approve and retroactively implemented in December 2010. I said DO WHAT???? Then he tried to tell me "Yes, ma'am closing took till Dec 2010 to implement the modification that you signed in Dec 2009!" Then he tells me that we have not made a payment since November 2009 I Flipped again! Because I have supporting documents stating otherwise and he has no clue who he just upset. I need advice I need help I dont know what I need at this point but you had best believe that I contacted the senators office with this new information. On top of that he gave me a different set of dates that the CEO and Presidents office didnt give me. How many sets of books does this company have and how many do not co-inside with each other? My Lord someone give me a break!

Got a call from the Negotiator today

Apparently I needed to contact the office of Senator Burr long before now! Reason being is that it really has moved in the past month. What I have found out today is that they have a final approval and paperwork is in the making. Of course he could not find the specifics on the account but that there is a significant payment reduction and interest rate reduction THANK GOD that's what I have to say! There was a date error on the paperwork or he would have had that info at his finger tips. So by the end of this week we will be looking for that lovely package from UPS and I am MORE than willing to get that crap done. They are talking about $275 reduction in payments that alone will make our lives much easier. They will drop all late fees and fix our credit reports! So this isnt over yet! The fat lady has yet to burst out into song!

If BOA could crap on any one they certainly have done so!

Ok so BOA was given until 7-15-2011 to respond to Senator Burrs office and boy did they ever respond. Not only did they respond but they ripped us a new one!

The letter they sent to Senator Burrs office reads:
Dear Mr. Sawyer,
Bank of america's office of the CEO and President acknowledges receipt of your correspondence dated June 9,2011, forwarded to us by the Office of the Honorable Richard Burr. As a Customer Advocate, I welcome this opportunity to address your concerns. 


In your correspondence, you expressed concern regarding previous attempts to modify your loan; specifically  your dissatisfaction with the lengthy review process, and multiple assigned negotiators. Additionally, you indicated frustration concerning numerous documentation requests, and more specifically, the loan modification declines in Novemeber 2009, March 2010, and March 2011. Further, you expressed a lack of understanding to the foreclosure process. You have requested a new modification review be initiated. Finally, you disclosed your dissatisfaction with customer service; primarily the misinformation and miscommunication provided by Bank of America. I trust I have accurately summarized your concerns. 


In my research of your account, I have confirmed a modification review commenced on November 24, 2009. Bank of America mailed you a permanent modification package that day. On December 12, 2009, your modification was decined. A payment in the amount of $853.18 was required along with your signed and notarized modification package to facilitate approval. That did not occur. Another modification review began on March 26,2010, in with a request for financial documentation was made and required to be returned by April 17, 2010, we did not receive the requested documents by this required due date. Bank of America made a final request for documentation on May 20,2010. Your loan was declined for the Making Home Affordable (MHA) program on June 26,2010 due to a high positive surplus, but was kept open for further review options. Document requests were then sent on June 20,2010 and on July 1, 2010. Subsequent documents returned were deemed to be incomplete. Receipt of all required documentation occurred on August 12,2010. During this review process you made a request to honor the offer from November 2009, but were denied and review continued. A proprietary modification offer was sent on August 27,2010, with a request that documentation be returned by September 10,2010. As of October 6, 2010, the documentation had not been received, and your review was closed. Another modification review began on January 5,2011. We received your signed documents on April 13,2011, and your modification was submitted for approval. On May 3, 2011, your review was declined for the Home Affordable Modification Program (HAMP); however, remains under review for other possible modification options as of the date of this correspondence. Your assigned negotiator is Mr. Nicholas Neisen can be contacted directly at 1-877-430-1431 ext 204319, Monday through Friday from 12:30-9 pm EST. Please contact him with any questions pertaining to your loan modification review. 


Please note that there is no guarantee of assistance and approval is dependent upon several factors, however, Bank of America is committed to finding the best possible solutions for our customers. Please know that we are striving to find the best possible solution in the timeliest manner possible; however, the review for loan modification is lengthy, requiring updated financial information every 60 days. Updated documents are required for an accurate review for assistance and we may request these documents multiple times. 


My attempts to contact you on July 8,2011 and again on July 13,2011 were unsuccessful. Unfortunately, the Authorized Third Party (ATP) we had on file pertaining to Ms. Christine Sawyer, is no longer valid. Ms. Sawyer was the ATP for the Countrywide loan ; however, Bank of America now owns and services the loan. Privacy policy states that Ms.Sawyer must sign a new ATP in order for Bank of America to speak to her regarding this account.

Ok let me just say OMG does this letter just royally PISS ME OFF! Because he really throws us under the bus. Here is the highlights of what really really irks me:
1- Further, you expressed a lack of understanding of the foreclosure process. Not ONCE did I say anything about not understanding the foreclosure process. 
2-A payment in the amount of $853.18 was required along with your signed and notarized modification package to facilitate approval. That did not occur. We had discussed with the representative that since there was over $900 in the holding pot that we did not have to make that initial payment and that was told that it was OK for us to use those funds for the first payment.
3-On December 12, 2009, your modification was decined. This is new news to me because the paper work was not due back until December 17,2009! The actual decline was March 17,2010.
4-Another modification review began on March 26,2010, in with a request for financial documentation was made and required to be returned by April 17, 2010, we did not receive the requested documents by this required due date. Let me just call BS right now because I had faxed AND Fed-Ex'd the paperwork requested to them NUMEROUS times! 
5-Your loan was declined for the Making Home Affordable (MHA) program on June 26,2010 due to a high positive surplus, but was kept open for further review options. WOW this yet again is new news to me! We did not receive the decline letter for this until March 2011! Talk about taking their time letting their customers know about it! We received over 10 Fed-ex Packages for the MHA in the month of June all the same wanting us to fill out the same paperwork that we had already sent in 3 times before in April! Their high positive surplus...........what high positive surplus? We came NO where near what they said we made a month! They stated we made over $5k a month (in what world?) He brings home $590 a week after taxes before taxes its $845 per week and they calculate it at 4.3 weeks so that's $3633.50 per month before taxes and health insurance. Not only that they were using MY income and I am not even on the loan! 
6-During this review process you made a request to honor the offer from November 2009, but were denied and review continued. Ok I made this request in March 2010 and in August of 2010 after contacting the Office of the President of BAC Home Loans,LP. This was after contacting the BBB and speaking with Stephen Fitzgerald. 
7-A proprietary modification offer was sent on August 27,2010, with a request that documentation be returned by September 10,2010. As of October 6, 2010, the documentation had not been received, and your review was closed. This modification was declined because our negotiator at the time (Amy Nemoyer) told us NOT to sign and send back the docs because she thought we could do better than that. 
8-Another modification review began on January 5,2011. We received your signed documents on April 13,2011, and your modification was submitted for approval.What in the hell are they talking about? We submitted updated information as of Jan 5,2011 we also submitted all signed docs on the SAME day Jan 5,2011 not April 13,2011. That is just when the Negotiator decided to input them in the system Not us! 
9-On May 3, 2011, your review was declined for the Home Affordable Modification Program (HAMP); however, remains under review for other possible modification options as of the date of this correspondence. Dear God REALLY??? Their use of the word "review" makes me sick. It was supposedly sent to the investor on May

Ok there may be some vindication here but....New update

Ok after dealing with many many many many incompetent people at BOA Home loans or what ever they are called now I ACTUALLY got to speak to my negotiator.......well new negotiator. Mr.Nicholas Nissen at 877-430-1431 ext 204319 he is in the office from 12-9 est so thats helpful information. THEN he looks through the account as I am speaking with him on the phone and says that we have been through a HUGE ordeal........well DUH! What makes you think that? Anyway, he states that we now have approval from the investor that it has to go through  somewhat of a process still to get everything completed. BUT.......I do not have the terms yet as they only sent the approval over from the investor but not the terms (weird but Ill take what I can get). We have to go through the whole QA process but we may be over and done with within a week...Crossing my fingers as this would be an answer to my prayers. Now if only I could sleep! I will update as soon as I hear from him regarding the terms of the modification.

Here's one for the books.............

This morning I received a call from BOA Home loans office of the CEO and president by an unnamed caller  because he declined to ID himself. and after he so nicely asked to speak to Jeffrey (My husband) I informed him that he was not available to speak right now as he is at work. So then he states that he will call back at a later time. I inform this unknown caller that I am able to speak on behalf of the loan and he states that the authorization that he has in front of him is for Countrywide. Good lord I have spoken with that office before and now he has me blacklisted from the office of the ceo and president as not able to be given anything but basic info no details of what is going on. I have never been so furious in my life. So I went totally unorthodox today and went on Facebook and Messaged both Amy and Ms. Amadasu to find out what in the world is going on with the loan mod as theres apparently something up but no one wants to tell me what is going on with my home. How stupid is this mess! One department sees that I am able to speak on behalf of the loan but the other screams sorry it was only for countrywide..............BOA bought ALL countrywide loans its the same loan number for gods sake AND i gave him any and all info that he wanted on the account and told him things that he didnt know. but to no avail I got nothing..............BUT Today is the last day BOA had to respond to the Office of the Commissioner of Banks for NC so lets see how that turned out!

New month same mess

I call into BOA on Friday 7/1/2011 and speak to Amy's Supervisor David and he tells me that nothing has happened on the loan and that it was still waiting on the Investor approval that was sent of on June 10th.........HOW MANY MORE TIMES WILL THIS DATE CHANGE.........what date did they send it to the Investor? This is Crap in the worst of ways. I attempt to get information and hear that word "REVIEW" it makes me want to PUKE! On another note there is yet another class action suit against BOA or BAC home loans whatever name you want to use for the same crap we are going through. I have yet again not heard from my Negotiator and her new number does not work....how convenient is that??

BOA has till July 8th to respond back to the Bank commissioner, I highly doubt they will respond to anything they send and they have till July 15th to respond to Senator Burrs office, yet again I highly doubt they will respond to that one either.

OH.............I know I am jumping around today Amys manager David stated to me that she was supposed to be contacting me at least twice a week instead of me contacting them twice a week.....I havent seen that since this whole thing started.  I have to contact or it just doesnt happen.

Whats new in the world of BOA and their scam artist ways.........they now tell me that it has been reassigned to amy AGAIN and so i email her after being told by the home retention iddiots that i am to call back in a month....boy do they NOT know me! I will call repeatedly till i get answers!  I cannot get ahold of her as she now has a new phone number and extention and guess what to my surprise it doesnt work....guess now i will be contacting Senator Burr and get this fixed what a mess this has become. Lisa at Home retention was a total Bitty for lack of better words in a PC world. she states what do you want me to do about this you know you need to pay your bills yadda yadda yadda GRRRR........

Got a letter

From the US Senate Mr Richard Burr.......he stated that he has contacted the appropriate peoples and if I should need his help to let him know and if I hear anything from BOA to let him know. Im going to tell you what I am going to make as big of a stink as I can about this. It is ridiculous that it has gotten this far and if anyone who has an attorney that wants to get a hold of BOA please let me know this is just a night mare that I want out of!

Holy shit what a mess!!!!!!!!!

Ok so I call in after not being able to get my negotiator on the phone all to be told that..........you have been reassigned to Mr. Charles Moss 888-875-1609 ext 5580. When I called in the first time to the regular line it took me to Home Retention where I spoke with Kimberly who informed me it was assigned on the 13th to him, I called in on the 17th and was never given this information! Go figure......THEN i was told it was reactivated whatever that meant. Then was sent over to Eukeria in the status department at 888-325-5399 who told me there was no information for Mr.Moss that they could give out. That they could only contact him for me Via E-mail. (let me call the BS card right now because as per Barbara J. Desoers press conference they are to give a single point of contact and that wasn't for the status department LOL). I then look up the office of the CEO number and guess what its a local number I call it and speak with Holly who then gives me Mr.Moss's info to call and find out what is going on and why we were not contacted in the week that hes had the account letting us know it has been reassigned! I am now faxing over the Privacy Act release form to Senator Burrs office as we speak so that I can get some sort of resolution to this it is a nightmare! I am also giving them a link to this blog so that they can read everything that has gone on. Lets hope and pray for the best because I am about to go BATTY!

Yeah right no surprise there! I cannot get a hold of ANYONE on my Negotiators team they all have decided it was super awesome to go on vacation at the same damn time! Sure that's great and all BUT when you have peoples lives hanging in the rafters its better to have a life vest than to let them all drowned. Not one single life vest till the 28th! that is just super sweet of them. Email negotiator get a vacation reply, message her manager get a vacation reply, message his manager get a vacation reply What the hell is going on here? Conspiracy?? Maybe!

Ok well now I have yet MORE news!

I called BOA today as I have not gotten a response from the negotiator as of yet as to what is going on with this whole process. And low and behold how about this wonderful woman has sent our stuff off to the negotiator not when she said she did but on the 7th of june! OMG really???? SO then in the mail today I get a letter from the Gov. of NC telling me that she does expect a response back asap from BOA and the OCC and the Commissioner of Banks.....Lets see if this lights a fire under their rear end!!

She knew that Fannie Mae was going to take their time BUT from what I was told by an agent about a month

them if that is the case she knows if it is approved or not because this is week two! 
I can't wait to either have an attorney on this or get this approved it should not have ever taken us 2 years to get 
this finished. 
I call BOA and they are amazed at how many times I have called in an notated in my own notes what is going on.
It is a little disturbing though that one week we are told there is nothing for us and then the next "Oh we are sending 
the documents to the Investor for them to approve them.

Today was a particularly busy day in the day of BOA Haters LOL

I got a letter for the NC Department of Justice Consumer Protection! FINALLY someone higher up listed to me! They notified BOA that there is an issue with the way they are doing business and they have 15 days to respond to the notice! Woo Hoo! First BOA gets foreclosed upon THEN I get a letter from NC DOJ thats just super sweet! I love when I have my little fax fest and get response out of it! It makes me do a happy dance (Be VERY glad no one on here can see me do that LOL).

Here are the lovely Docs that I have received from BOA now this is NOT the new ones that are supposedly coming to us:
This is the DOC they sent to us to solicit a HAMP mod from us.........Ok well we sent that back the SAME DAY! This doc we were supposed to hear back from BOA in 30 days as per the conversation that We had on the phone with them!

This is the doc they sent us telling us that we were not qualified for the FANNIE MAE Mod NOT MHA as per the conversation that I had with three different reps.



This is the paper that was sent by our negotaitor AFTER contacting her Manager and Emailing the OPP for help and asking to be reassigned yet again it was to HER!



these are the docs that were sent to us in Sept. of 2010 that our negotiator told us NOT to sign and send back to BOA and that she had NO clue where they came from! 


These are the docs that BOA said they could not see the seal. If you look hard you can see where there is some distortion on the docs where the seal is. 

WOW 30 days after and i have gotten it only in 2011 , 9 months later!

Ok for everyone who wants vindication on Bank Of America this family really got it! I only wish I could have been there to see it!


A couple who paid cash for their house somehow got foreclosed upon by Bank of America.  A court battle ensued, which Bank of America lost.  The judge ordered them to pay attorney and court fees to the couple who were victims of their error.

Five months later, the bank still hadn't paid.  So the couple did the natural thing--they foreclosed upon the bank.  After an hour of being locked out by bailiffs while their furniture, computers, and any cash in the till was seized, the bank branch manager somehow managed to get them a check.

One hopes that the check included interest, outrageous penalty fees, and of course, the cost of the moving van they used for the "foreclosure".  A bank that erroneously forecloses on someone who has never even been a customer should be falling all over themselves to make it right, not dragging their feet on paying the bills they forced homeowners to incur.  That they felt free to drag it out shows that they fear neither courts nor bad publicity.  Hopefully, this incident will inspire more homeowners--and a little more dedication to compliance on the part of the big banks.

Ok so much has gone on since I last posted!

Of course I have done my daily calls to BOA as usual and all to be told the same thing.........."you're in reveiw". Then.........THEN.........today I e-mail Amy just on a whim and I get back from her "YEP! I wanted to E-mail you first thing this morning. But I got a little bogged down this morning. Management approved the terms that I came up with for you. I have to change some dates so that we stay in compliance and to allow for closing AND I am submitting them to the investor TODAY. Hope that makes you smile!"

This was verbatim the E-mail that she sent me. NOW mind you it made me smirk just a little but smile NO! I will not smile until we have final paperwork from BOA because this still does not allow me to breathe a sigh of relief. Thank you all who support me in this fight against the bank of the devil! And for the lovely couple that contacted me this morning who shall remain anonymous THANKS!!!!!!! Its great to hear from people in my area that are going through the same thing........much less the same negotiator how funny is that! and yes it is sad that this is what it takes to bring people together!

Trying to wake up from this HORRIBLE nightmare! *LONG*

For a bank that took millions of TARP funds and promised to help families, they certainly are not doing so. My families home has been in modification with BOA since July 2009.

November 2009, we receive BOA sent us modification papers that my husband signed, notarized and sent back before the deadline. We called every Monday and every Friday to make sure everything was in "working" order and that we did everything according to their specifications. We were told repeatedly that everything was OK and we had no reason to worry. We them made our new modification payments as we were told.

March 2010, we receive a Fed-Ex package from BOA. It then stated we were denied the modification that we signed notarized and sent back in December. All of this was denied due to a notary seal not being an ink stamp notary seal. It was the normal paper embossed notary seal and they could not see it on a scanned document. We had NEVER heard of such a thing as an ink stamp notary seal. We were never told to use that sort of thing either when we called twice weekly to make sure that everything was OK.  I immediately call the 866-669-6607 number that I always called, and they said that since the documents were not done correctly we would have to start over. NOT once mentioning that we could appeal the decision or that we could use the other copy that we had and get it re-notarized and sent back to them. They just state that it would be better to start over again.
However after looking at the original document that they so graciously sent back to me if you looked at the words on the paper you could see that they were a little distorted as if the paper had be crumpled. I took a pencil lightly colored over the notary seal and low and behold my goodness there it was the whole time.......

June 2010, so three months after "starting over" again, I find out that I have to have a hysterectomy at age 29, I decided I was tired of hearing the words that anyone in a modification dreads to hear, and if I had a dollar for every time I heard this phrase I would not need a modification, "you're in review", I wrote the Better Business Bureau. I was then contacted in less than a week from a Stephen Fitzgerald with BAC Home Loans Consumer Advocacy Department. After quite some time I have come to know this department as the B.S. department. Mr. Fitzgerald informed me that this would be rectified in 20 days as per the BBB regulations. I thought this is great as my surgery would be after this was taken care of and I would not have to worry about it anymore. Well low and behold I should not have held my breath, I  think I was turning blue at this point, I get a call from Mr.Fitzgerald the day of my surgery stating that the modification needed to be handled by a negotiator named Tracy. Now mind you I am trying to hold an intelligent conversation while doped up on morphine. I had just had my uterus ripped out of my body for goodness sake and he knew that!

So then Mr.Fitzgerald tells me that everything will be OK and the modification would be taken care of within 30-45 days and we would be set to go.

August 8,2010, I contact the Office of the President of Bank of America Home Loans (Barbra Desoer's office).I let that office know the mess of things that their modification department and their consumer advocacy department was putting people through, thinking they would care. They then assign me a new negotiator who would now be at my demise, by the name of Amy Nemoyer. She comes across all nice and sweet and caring telling me she watched her family go through the same thing and that they came out of it ok and we will too. She then states "oh it will only take two weeks". If I had a dollar for every time I heard her say "two weeks". I am just so glad I started an E-mail trail for Ms.Nemoyer and myself, it has really saved my rear end because of some of the things that she has stated to me, then tried to re-nig on it.

Sept 2010, we receive modification papers, I call to tell our negotiator of them and she states shes never sent any out and is not sure where they came from. It was at that time I did some investigating and found out it was from the Home Retention department. I then call my negotiator and tell her what I found out and what the terms were (they were acceptable to us). She then states to not sign and send back those set of modification papers as she could do better. Mind you, I have this in an E-mail from Ms.Nemoyer.She then has me resend our financial information over to her and we do as we are told to do, I scan and E-mail them to her as to have that "paper" trail and she lets me know she received them and it would be another two weeks till this is resolved and we are in the clear.

October 16, 2010, Ms.Nemoyer informs us by Email not to make payments on the loan any longer as it could hinder the modification process and lengthen the process. That she needed to reverse a few payments that we made so that she could get the modification complete. This would only take her 3-5 days. October came and went. Now a month had passed it is now November and I contact Ms.Nemoyer who states that I am not the only one waiting on reversals that I should not expect it any time soon as I am not special and should be treated as such. First off I was not asking to be treated special just given an update on what in the world was going on with my modification. At this time it was then sent over to Mr.Anthony Palma. He was able to look at the loan and get the payments that needed to be reversed on the account within 3 days no problem and stated that he was not sure why it took her so long to even attempt to do so. About a week after the payments were reversed he then tells me that since it had taken this long to do the modificion we would have to come out of pocket with $8000. I was floored. This was because Ms.Nemoyer stated that we should not make any payments on the account until this was resolved. By this time it was January 06,2011.

I then get a call from Amy stating that she had the loan again and we would start over on the modification process. I flip out on her. This is becoming one of the worst long drawn out processes that could ever happen to anyone. At this time I get a call from Amys Supervisors supervisor the supposed "team lead". Her name is Aimiamia Amadasu and little did I know Amy was on the line too. I explained EVERYTHING to her manager and thats when Amy spoke up stating that she never said that we were not to make a payment. She didnt "recall" stating that to me. Well thats why I keep E-mails! I informed her manager of the emails and forwarded them to her and was told that she needed to speak with Amy about this whole thing. I was then told to forward all my financials to Ms.Amadasu and that it should not be much longer before this is resolved.

So i resent everything that Ms.Amadasu asked for and was told on March 17th,2011 that we were denied for the Fannie Mae MHA loan modification and that we were going to be able to get a modification through BOA itself. This is all after Mr.Palma stated to me that we would have a modification giving us payments of $644.75 a month and dropping our rate on the 30 year loan to 2% for the first 5 years then it steps up each year topping out at 5.2% for the remainder of the loan.

At this time I am making my phone calls twice a week some times more to make sure everything is on the up and up and am told "you are in review". April comes and goes then comes May.  I call May 3rd, and am told we are not eligible for the federal HAMP program that we should still wait for the review of the in-house modification to come through. I call on May 10th and am told we are still "in review". On May 13th 2011, I call in to find out what is going on and this time I am told we are not eligible for any modification and now need to pay them $16000.00 or be foreclosed on because there were no modifications available to me.
All this time we had been told we would be OK they would get it rectified. Mind you we had TWO modifications come through to us. One of them we sent in signed notarized and on time, the second one a BOA negotiator told us to not sign and send back. And now here we sit on the brink of losing every thing we have worked so hard for because of one simple thing that should have been stated almost years ago!

I am now on a campaign to write everyone I can so that they would listen and hopefully help us do something about this situation. If anyone is having issues with this company or can help us figure out what to do from here please feel free to email.
